This Fortune Cooke Milk Tea Peel-Off Instant Win Game & Free Meals for a Year Sweepstakes (the “Game”) shall be subject to these official rules (the “Official Rules”), and by entering or otherwise participating, you agree to be bound by the terms and conditions set forth herein.

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
SPONSOR: The Game sponsor is Panda Restaurant Group, Inc., 1683 Walnut Grove Avenue, Rosemead, CA 91770 (the “Sponsor”).
ENTRY PERIOD: The Game starts on March 1, 2022 and ends on May 2, 2022 (the “Entry Period”).
HOW TO PLAY: The Game has two components. The first component is an instant win game (the “Instant Win Game”). For this component of the Game, everyone who purchases a Fortune Cookie Milk Tea and receives a game piece wins a prize (each, an “Instant Win Prize”). This component of the game has no element of chance. The second component of the Game is a sweepstakes (the “Sweepstakes”), the winners of which will receive 1 free entrée a week for a year, subject to the terms and conditions of these Official Rules (each, a “Grand Prize”).
How to Enter the Instant Win Game: While supplies last, receive 1 game piece by purchasing a Fortune Cookie Milk Tea from a Panda Inn location in California (each, a “Participating Location”) during the Entry Period. All game pieces provide an Instant-Win Prize.
Note that there are a limited number of game pieces—5,004. Thus, game pieces may or may not be available at a particular Participating Location during the Entry Period. If you plan to purchase a Fortune Cookie Milk Tea solely to receive a game piece, you should inquire about game piece availability before placing your order.
How to Enter the Sweepstakes: There are 2 ways to enter the Sweepstakes (each of which provides 1 chance to win a Grand Prize):

On a postcard or other card that is no smaller than 3½ x 5 inches and no larger than 4¼ x 6 inches, legibly handwrite: (1) your complete name, (2) your mailing address, (3) your home address (if it differs from your mailing address), (4) your phone number, and (5) your date of birth, and, during the Entry Period, mail it with proper postage to: Panda Inn, 3488 E. Foothill Blvd, Pasadena, CA 91107. Each write-in entry provides 1 chance at winning a Grand Prize. Limit: 1 write-in entry per person. Mail-in Entries must be post-marked during the Entry Period and received no later than April 8, 2022. No mechanical reproductions will be accepted. Write-in entries must be handwritten and contain all information identified above; otherwise, they are void and will not be eligible to win.
With respect to write-in entries, only you may enter on your behalf (and only on your behalf). Entries made for you by any other person or entity, or by any other method, including but not limited to commercial sweepstakes subscription notification and/or entering services will be declared invalid and disqualified from the Sweepstakes. The use of any device to automate the write-in entry process is prohibited. If you are found to have submitted any unauthorized entry, all of your entries, including entries that would have otherwise been authorized, will be disqualified from the Sweepstakes. |
There is no prohibition on combining entry methods. Persons who enter by purchasing a Fortune Cookie Milk Tea may also enter by submitting a write-in entry and vice versa. All entries are subject to verification of eligibility and compliance with the terms of these Official Rules.
ELIGIBILITY: OPEN ONLY TO LEGAL RESIDENTS OF CALIFORNIA, 18 YEARS OF AGE OR OLDER. VOID OUTSIDE OF CALIFORNIA AND WHERE PROHIBITED. Sponsor’s employees, officers, directors, contractors, agents, affiliates, parent, subsidiaries, any of their immediate family and/or household members are not eligible to enter or win any prize. By participating, you agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on all matters relating to the Game. Failure to agree renders you ineligible. The Game is subject to all applicable federal, state, and local laws.
PRIZES: At least 5 Sweepstakes winners (4 purchase entry winners and at least 1 mail-in entry winner) will be awarded a Grand Prize of 1 entrée at a single Participating Location each week for a year, for a total of up to 52 entrees (approximate retail value $884).
5,000 Instant Win Game winners will be awarded 1 of the following 8 Instant Win Prizes (approximate retail value of $6-$25):

All prizes are awarded “as is” with no guarantee or warranty, either express or implied. Winners may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winners are responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Limit 1 Grand Prize per household. If by reason of a printing, typographical, or other error, more Grand Prizes won via purchase entry are claimed than the number set forth in these Official Rules, the first Grand Prize winner at each Participating Location will be awarded a Grand Prize, and all subsequent persons making purportedly valid claims will be added to the write-in entry drawing described below. Subject to the below-described procedure for ensuring that the odds of winning by write-in entry remain at least as good as the odds of winning by purchase entry, no more than the advertised number of Grand Prizes will be awarded.
WINNER SELECTION, ODDS OF WINNING, CLAIMING YOUR PRIZE
Instant Win Prizes: There are 5,004 game pieces, 5,000 of which are Instant Win Prizes, and 4 of which are Grand Prizes. All 5,004 game pieces are winners. The odds of purchasing a winning game piece therefore are 1 in 1. To claim one of the 5,000 Instant Win Prizes, redeem your original winning game piece at any Participating Location by no later than April 1, 2023. Prize must be redeemed on a future visit. There is one (1) redemption per dine-in table or per take-out order. ONLY ORIGINAL GAME PIECES WILL BE ACCEPTED FOR PRIZE REDEMPTION.
Grand Prizes: 4 of the 5,004 game pieces are Grand Prizes. The odds of purchasing a Grand Prize winning game piece therefore are 1 in 1,251. To claim one of the 4 Grand Prizes available by purchase entry, you must present your winning game piece at the Participating Location at which you received it (your “Winning Location”) on the same day that you received it. ONLY ORIGINAL GAME PIECES WILL BE ACCEPTED FOR PRIZE REDEMPTION. Upon redemption, and subject to all other terms and conditions in the Official Rules, you will then receive a Grand Prize Voucher Book, entitling you to a free entrée at your Winning Location once each week for up to 52 consecutive weeks beginning on April 10, 2022 and ending on April 9, 2023 (the “Prize Term”).
At least 1 additional Grand Prize winner will be randomly selected from the pool of eligible write-in entries. This winner will be selected by a computer generated random drawing within approximately 14 days of the Entry Period ending. The odds of winning are determined by the number of eligible write-in entries received. If the pool of eligible write-in entries exceeds 1,251, a second winner will be selected to ensure that the odds of winning by write-in entry are at least as good as they are by winning by purchase entry. The write-in entry winner(s) will be notified within approximately 7 days of the date of the drawing. For Grand Prize winners who win by write-in entry, your Winning Location will be the Participating Location nearest to the home address provided in your write-in entry.
Grand Prize winners will be required to execute and return an affidavit of eligibility, a liability release, a publicity release, and an IRS 1099 form, prior to prize redemption. If such documents are not returned by purchase entry winners on the same day of winning, or by write-in entry winners within 30 days of notification, or if a potential Grand Prize winner is not otherwise in compliance with these Official Rules, the Grand Prize will be deemed forfeited, and, at Sponsor’s discretion, an alternate winner will be selected by repeating the write-in entry drawing process.
If you are a Grand Prize winner, you must present your Grand Prize Voucher to receive a free entrée during the Prize Term. You cannot receive an entrée without it. Failure to redeem your Grand Prize Voucher for an entrée in any week during the Prize Period voids your entitlement to that week’s entrée. In the event your Winning Location goes out of business, shuts down, temporarily or permanently closes, or is otherwise unable to honor all or part of your Grand Prize Voucher for any reason whatsoever during the Prize Term (each, a “Closure Event”), any entrées that you would have been entitled to but for the Closure Event shall become void, and Sponsor shall have no obligation to provide you with anything to recoup any value lost during or as a result of the Closure Event. The foregoing notwithstanding, upon notice by you, Sponsor may, in its sole discretion, elect to provide you with a similar or different prize that may or may not be comparable in value to any value lost by virtue of a Closure Event. You are solely responsible for your Grand Prize Voucher. Sponsor will not issue a new one in the event that it is lost or stolen, and Sponsor shall have no obligation to provide you with anything to recoup any value lost. The foregoing notwithstanding, upon notice by you, the management of your Winning Location may, in its sole discretion, elect to provide you with a similar or different prize that may or may not be comparable in value to any value lost as a result of your Grand Prize Voucher being lost or stolen.
PUBLICITY GRANT: By acceptance of a prize, except where prohibited by law, each winner agrees to the use by Sponsor and its designees of their name, likeness, picture and city and state of residence and prize won for advertising, promotional and publicity purposes, without additional compensation or prior review, in any and all media, now known or to be developed, worldwide, in perpetuity; and upon request will provide specific written consent to any use as requested by Sponsor.
GENERAL RELEASE & CONDITIONS: By participating, you agree to release, discharge and hold harmless Sponsor, its parent, affiliates, subsidiaries, and advertising and promotion agencies and all of their respective directors, officers and employees and agents (collectively, “Released Parties”) from any and all liability, claims, losses and damages, regardless of the cause, arising out of their participation in the Game and the acceptance and use/consumption of a prize (including any travel or activity-related thereto). Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, illegible, delayed, or postage-due mail, entries, game pieces, requests or other communications; or errors or difficulties of any kind whether human, mechanical, typographical, printing or otherwise relating to or in connection with the Game, including, without limitation, errors or difficulties which may occur in connection with the administration of the Game, the processing of requests, entries or prize claims, and the announcement of the prizes or winners in any Game-related materials.
Game piece is void if not obtained from authorized and legitimate channels, or if the game piece is, in whole or in part, illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained via fraud or theft. Released Parties are not liable for printer errors or issuance of any void, misprinted, or irregular game piece resulting from production or packaging problems or errors. Liability for an irregular game piece is limited to providing another game piece, while supplies last, subject to verification of original game piece irregularity. Game pieces cannot be bartered, auctioned or sold and any such game pieces may be void.
Sponsor reserves the right, at its sole discretion, to disqualify any individual who it determines is not in compliance with these Official Rules or attempts to corrupt or impair the honest and legitimate conduct of the Game and void all associated game pieces/prize claims. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Game at any time and for any reason, including but not limited to, should any portion of the Game be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, and, if terminated, at its discretion, award any unclaimed Grand Prizes in any manner deemed fair and appropriate by Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
ARBITRATION:EXCEPT WHERE PROHIBITED BY LAW, AS A CONDITION OF PARTICIPATING IN THIS GAME, ENTRANT AGREES THAT (1) ANY AND ALL DISPUTES AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS GAME, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY FINAL AND BINDING ARBITRATION UNDER THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION AND HELD AT THE AAA REGIONAL OFFICE NEAREST THE ENTRANT; (2) THE FEDERAL ARBITRATION ACT SHALL GOVERN THE INTERPRETATION, ENFORCEMENT AND ALL PROCEEDINGS AT SUCH ARBITRATION; AND (3) JUDGMENT UPON SUCH ARBITRATION AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION. UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES, INCLUDING ATTORNEYS’ FEES, OTHER THAN ENTRANT’S ACTUAL OUT-OF-POCKET EXPENSES (I.E., COSTS ASSOCIATED WITH PARTICIPATING IN THIS GAME), AND ENTRANT FURTHER WAIVES ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.
GOVERNING LAW/DISPUTES: By entering the Game, and only to the extent that a duly authorized court determines that arbitration is unavailable (which should not be the case), you hereby submit to the jurisdiction and venue of the federal and state courts of Los Angeles, California and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum. In such a case, the Game shall be governed by the laws of the State of California. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorneys’ fees or costs; and under no circumstances will any individual be permitted to obtain awards for punitive, consequential or incidental damages; and entrants hereby waive any and all rights therefore and of any right to have damages multiplied or otherwise increased.
WINNERS LIST: For the names of the Grand Prize winners, send a self-addressed stamped envelope to: Panda Inn, ATTN: Fortune Cookie Milk Tea Game Winner’s List, 3488 E. Foothill Blvd, Pasadena, CA 91107. You will then receive the winner’s list approximately 30 days following selection of the final Grand Prize winner.
